The Independent Community Bankers of America (ICBA) filed a lawsuit against the Office of the Comptroller of the Currency (OCC) in the U.S. District Court for the District of Columbia on October 2. The complaint challenges the regulator's authority to grant national trust bank charters to cryptocurrency companies, specifically citing Coinbase, Circle, and Crypto.com. ICBA argues that the OCC’s February 2026 final rule and its January 2021 Interpretive Letter 1176 improperly allowed digital-asset firms to obtain federal charters without adhering to requirements applicable to insured traditional banks.

The dispute centers on the interpretation of Section 27(a) of the National Bank Act regarding non-fiduciary activities. ICBA contends that Congress did not intend national trust charters to serve as a pathway for crypto firms to gain banking credibility while avoiding capital, liquidity, and supervisory standards required of insured depository institutions. The lawsuit seeks to invalidate the March 2026 chartering rule and revoke the charter of Protego, one of 21 approved or conditionally approved trust banks identified in the complaint, 13 of which have ties to the cryptocurrency industry.
